Terms of Service

Agreement to these Terms

You accept these Terms when you create an account and each time you use the service. The sign-up screen states that creating an account means you agree to these Terms and the Privacy Policy. If you are using the service for a company or other organisation, you confirm that you have authority to bind it to these Terms.

These Terms incorporate our Privacy Policy, which explains how we handle personal data, and our Data Processing Addendum, which governs personal data within the lead lists you extract. Agreeing to these Terms means you also agree to both. If you do not agree, do not create an account or use the service.

The service

Live Map Leads is a self-serve tool that retrieves lists of local businesses from Google Maps based on the search criteria you choose, and lets you download them or send them to your CRM. We provide the tool; you decide what to search for and how to use the results.

Eligibility and accounts

• You must be at least 18 years old and able to enter into a contract.
• You must provide accurate account information and keep it up to date.
• You are responsible for activity under your account and for keeping your sign-in credentials secure.
• Any free or promotional credit grant is limited to one per person or organisation. Attempting to create multiple accounts to claim it repeatedly is prohibited.

Credits, billing, and refunds

Live Map Leads is pay-as-you-go. There is no subscription.

• You buy credits in bulk. One credit equals one business record returned to you.
• We charge on success only. You are charged only for the records we actually deliver. A search that returns no results costs nothing.
• Credits do not expire.
• Fair-Play guarantee: if a delivered lead is broken or uncontactable, we refund that credit. You never pay for a lead you can't reach.
• Credits already spent on records delivered to you are non-refundable, except under the Fair-Play guarantee above.
• Unused, unspent credit balances are non-refundable, except as described in the Termination section (if we discontinue the service or end your account for our own convenience, we refund your unused balance).
• Prices are shown in US dollars (USD) and are exclusive of tax. Any tax that applies based on your location is calculated and added at checkout.

Acceptable use

You are solely responsible for how you search for, store, and use the business and lead data you obtain through the service. You must:

• Comply with all applicable laws, including data-protection laws (such as the GDPR and the CCPA) and anti-spam laws (such as CAN-SPAM, CASL, and the EU e-Privacy rules) when you contact businesses.
• Have a legitimate, lawful basis to collect and process any personal data contained in your results.
• Respect the terms and rights of Google and the businesses whose data appears in results.

You must not:

• Use the service for any unlawful, harassing, fraudulent, or abusive purpose, or to send unlawful spam.
• Resell, redistribute, or use the data in a way that violates applicable law or third-party rights.
• Attempt to circumvent credit, billing, or anti-abuse controls, or access the service through automated means beyond the intended product.
• Reverse engineer, disrupt, overload, or attempt to gain unauthorised access to the service or its infrastructure.

We will suspend or terminate accounts that breach this section.

Data protection roles

For any personal data contained in the lead lists you extract, you are the data controller and we act as your processor, on your instructions (the search parameters you submit). We are not a joint controller with you. The details are set out in our Data Processing Addendum, which forms part of these Terms. For your own account, billing, and usage data, we are the controller, as described in our Privacy Policy.

Third-party data and services

Results are retrieved from Google Maps through a third-party data provider. The data is created and controlled by third parties. We do not guarantee that any listing is accurate, complete, current, or available, and we are not responsible for the content of third-party data or the availability of third-party services.

Intellectual property

We own the Live Map Leads platform, software, and branding. You retain ownership of the search inputs and account information you provide. The business-listing data you retrieve is third-party data and may be subject to third-party rights; these Terms grant you no ownership of it.

Service provided "as is"

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any data will meet your requirements.

Limitation of liability

To the maximum extent permitted by law, Live Map Leads and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service.

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or related to the service will not exceed the greater of (a) the total amount you paid us in the 12 months before the event giving rise to the claim, or (b) US $100. Nothing in these Terms limits liability that cannot be limited under applicable law.

Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages. In those jurisdictions, the exclusions and limitations in these Terms apply only to the maximum extent permitted by law, so some of them may not apply to you, and nothing in these Terms removes or limits any mandatory rights you have as a consumer.

Indemnification

You agree to indemnify and hold harmless Live Map Leads and its operators from any third-party claim, loss, or liability (including reasonable legal fees) arising from your breach of these Terms, your misuse of the service, the way you collect, store, or use the data you obtain through it, or your violation of applicable law or the rights of any third party.

Termination

You may close your account at any time. We will suspend or terminate your access if you breach these Terms or use the service unlawfully. If you close your account, or we suspend or terminate it because you breached these Terms, any unused credit balance is forfeited and is not refunded, consistent with the Credits, billing, and refunds section above. If we discontinue the service or end your account for our own convenience, not because of anything you did wrong, we will refund your unused credit balance.

Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will update the Last updated date and give you reasonable notice before it takes effect, by email or an in-app notice. Continued use of the service after a change takes effect means you accept the updated Terms; if you do not agree, you may close your account.

Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The courts located in Ontario, Canada will have jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of any mandatory consumer-protection rules of the country where you live, and you may also be able to bring proceedings in your local courts.

General

• Entire agreement: these Terms, together with the Privacy Policy, are the entire agreement between you and us about the service, and replace any earlier agreement on the same subject.
• Severability: if any part of these Terms is found unenforceable, the rest stays in force, and the unenforceable part is limited or removed only to the minimum extent necessary.
• No waiver: if we do not enforce a provision, that is not a waiver of our right to enforce it later.
• Assignment: you may not transfer your rights or obligations under these Terms without our consent. We may transfer ours, for example, as part of a merger, acquisition, or sale of assets, and will tell you if we do.
• Notices: we may give you notices by email, through the service, or by posting them on the website. You contact us using the details in the Contact section.
